As for licensing, I don't think the labels issue licenses at all, unless it's for a track for their own albums (e.g. "Rapture Riders"). I got all their tracks posted on their websites for free, they're not making any money from those.

But I like artistic recombining of existing fragments to make a new thing--it's what folk music has done for generations. Most on WFMU love the concept of mash-ups, but you can always make an argument against them.

Traditional fusion by a musician playing a a mix of styles on a musical instrument (possibly from yet another style) is not comparable to taking credit for using the laptop your parents bought you to do homework on to play a loop sampled from someone else's song.
