as teenager was stopped by the police once and had a box of water balloons in the back seat - we told them we where chucking them at drunk college kids. The cops laughed and didn't seem to care

my friend and I had just 4 filled water balloons, and the second car we hit was an angry off duty police officer who slamed on her brakes and the car behind her hit her and we ran across the street to get snacks but then she saw us and got like 3 police cars to come arrest us and we went to jail. and we go to court again on my birthday, we've been to court like 6 times already.

yes indeed. My lawyer is totally rad, he mostly does death penalty cases and most of his other clients are really mean. he has a cowboy hat. and his office has bronze statues of cowboys riding horses.

she says we were throwing water bottles and broke her side mirror. I knew not to trust HPD, but this just goes to show. I'm just glad my best friend is my co defendant and I didn't have to go to jail by myself.

But Liz, we need good, non-dimwits like you on juries, especially criminal juries to make sure DAs arent railroading defendants, as I know often happens in California, and probably New Jersey and NYC too.

Kurt beat me to the point I was going to make. It is definitely a civic duty and the more people who are articulate and thoughtful participate the better our judicial system outcomes are likely to be. That said, my experience is that being smart and articulate makes it hard to be appointed.

in my experience, trials are just drawn out productions in which logic and good sense take a back seat to manipulation and double talk.

Here's a likely wat to get off a jury: wear a WFMU t-shirt and when you are asked about it, which will likely happen, rant against corporate controlled mass media and the related doltification of the public. DAs don't like people like that.

Chris, I'm sure you worded things that way to fit into this tiny text box, since everyone knows that a criminal defendant is entitled to representation by counsel, regardless of ability to pay. And all defendants have the right to request a trial by jury. Quality of counsel is something else, of course.

No system that involves human beings will ever work in the theoretically "ideal" way. We're too clever for that.

There really isn't any justice, I get to go to trial if I feel like it because I can afford my lawyer and time off from work, but my co defendant cannot afford time off from work or the possibility of a conviction on her record so she might plead guilty and be on probation. Justice is a big gamble, especially the way criminal records work against people. The system is fucked and arrests seem to cause more harm than good often.

Public defenders are usually overworked, but they are also usually better at criminal defense than some person from the phone book. If you can afford the best, you definitely have a better chance, but the PDs are generally not as bad as people seem to think.

And Sandy is right -- often people plead guilty to things they didnt do to avoid the real possibility of conviction and significantly longer sentences. Unfortunately public defenders are somewhat likely to go along with this lesser of two bad results process.

MS - plea bargaining; its when you are told the risk of losing at trial so it becomes a safer bet to agree to a lesser charge because you can't afford a good laywer...a way around our rights...that's our wonderful legal system

I served on a fairly dull civil case in Newark but the courtrooms were beautiful -- really nice architecture -- but very strange melange of tunnels and hallways connecting some of the buildings.
