No system that involves human beings will ever work in the theoretically "ideal" way. We're too clever for that.

And Sandy is right -- often people plead guilty to things they didnt do to avoid the real possibility of conviction and significantly longer sentences. Unfortunately public defenders are somewhat likely to go along with this lesser of two bad results process.
