The issue that plays lambent over this referendum is that of land. Private landed property stamped indelibly upon the continent by the European (British) settlers/invaders destroyed the indigenous way of life. The Australian constitution does not recognize the Aborigines as the continent's original inhabitants. Until the early 1990s the legal fiction was that the continent was "terra nullius", i.e. that the land belonged to no one at the time of settlement/invasion and therefore could be claimed as Crown land.

The issue that plays lambent over this referendum is that of land. Private landed property stamped indelibly upon the continent by the European (British) settlers/invaders destroyed the indigenous way of life. The Australian constitution does not recognize the Aborigines as the continent's original inhabitants. Until the early 1990s the legal fiction was that the continent was "terra nullius", i.e. that the land belonged to no one at the time of settlement/invasion and therefore could be claimed as Crown land.
